1. About SwingSense
SwingSense is an AI-powered golf coaching application designed to help golfers analyse their swings, understand potential areas for improvement and access personalised coaching feedback and practice recommendations.
The application provides general golf coaching guidance and is intended for recreational, educational and training purposes.
2. User Accounts
Certain features of SwingSense require users to register for an account.
You agree to provide accurate information when registering and to keep your login details secure.
You are responsible for maintaining the confidentiality of your account and for notifying us if you suspect unauthorised access.
We reserve the right to suspend or terminate accounts where users misuse the application or breach these Terms.
3. Free and Premium Services
SwingSense offers both free and premium features.
Some features may require payment through a subscription or in-app purchase.
Any applicable prices, payment terms and subscription conditions will be displayed before purchase.
Subscriptions purchased through Apple or Google are subject to the relevant app store’s payment and subscription procedures.
Users can manage or cancel their subscriptions through the platform used to make the purchase.
Nothing in these Terms affects your statutory consumer rights.
4. AI-Generated Coaching
SwingSense uses artificial intelligence and automated analysis to provide golf coaching feedback.
Although we aim to provide useful and accurate information, AI-generated feedback may contain errors or inaccuracies.
SwingSense does not guarantee improvements in golfing performance or specific results from following its recommendations.
Users should exercise their own judgement when applying coaching advice.
SwingSense is not a substitute for professional medical advice or personalised instruction where appropriate.
5. User Content
Users may upload golf swing videos and other content to the application.
You retain ownership of your original uploaded content.
By uploading content, you grant SwingSense permission to process and use it as reasonably necessary to provide the application’s features and services.
You agree not to upload unlawful, offensive or copyrighted material without appropriate permission.
6. Intellectual Property
All SwingSense branding, software, designs, written content, instructional materials and other intellectual property are owned by SwingSense Ltd or its licensors.
Users may not reproduce, distribute or commercially exploit SwingSense content without permission, except where permitted by law.
7. Acceptable Use
You agree to use SwingSense lawfully and responsibly.
You must not attempt to interfere with the application’s security, access another user’s account without permission or misuse the Services in any way.
8. Health and Safety
Golf practice and physical activity may involve risks.
Users should ensure they practise in a safe environment and use appropriate equipment.
If you experience pain or discomfort when performing a recommended exercise or drill, stop the activity and seek appropriate professional advice.
SwingSense is not responsible for injuries caused by unsafe use of the application, except where liability cannot lawfully be excluded.
9. Availability of Services
We aim to keep SwingSense available and functioning correctly.
However, we cannot guarantee uninterrupted access or that the application will always be free from technical errors.
We may update, modify or improve features from time to time, subject to applicable consumer rights.
10. Limitation of Liability
SwingSense provides general golf coaching information and does not guarantee specific outcomes.
To the extent permitted by law, we are not responsible for losses resulting from misuse of the application or circumstances outside our reasonable control.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud or any other liability that cannot legally be excluded.
Nothing affects your statutory consumer rights.
11. Account Termination
Users may stop using SwingSense at any time and request deletion of their accounts by contacting support@swingsense.co.uk.
We may suspend or terminate accounts where necessary to address serious violations of these Terms, security risks or unlawful activity.
Deleting your account does not automatically cancel an active app-store subscription.
12. Changes to These Terms
We may update these Terms & Conditions to reflect changes to our Services, business practices or legal requirements.
Updated versions will be published on our website.
Where required by law, we will provide notice of material changes.
13. Governing Law
These Terms & Conditions are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply.
